1. Introduction

Welcome to Spark Works Creative. These Terms and Conditions govern your use of our website and services. By accessing or using our services, you agree to be bound by these terms. If you disagree with any part of these terms, you may not access our services.

2. Our Services

Spark Works Creative provides digital services including but not limited to Web Development, UI/UX Design, SEO, Graphic Design, Social Media Management, and AI Solutions.

• All project deliverables are subject to the specific scope of work defined in your project proposal.
• We reserve the right to refuse service to anyone for any reason at any time.

3. Intellectual Property

Upon full payment, the client is granted exclusive ownership of the final deliverables (e.g., website code, logos, designs). Spark Works Creative retains the right to:

• Use the completed work in our portfolio and marketing materials.
• Reuse underlying code libraries, frameworks, or tools developed by us that are not specific to the client's brand.

4. Payment Terms

Unless otherwise agreed in writing:

• A 50% non-refundable deposit is required to commence any project.
• The remaining 50% balance is due upon project completion, prior to final file handoff or site launch.
• Invoices not paid within 14 days of the due date may be subject to a late fee.

5. Limitation of Liability

Spark Works Creative shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use our services.
• Any unauthorized access to or use of our secure servers and/or any personal information stored therein.
• Third-party services or content used in your project (e.g., hosting providers, plugins, APIs).

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Spark Works Creative is registered, without regard to its conflict of law provisions.
